Theft: can I avoid a Felony conviction?

If you are charged with Theft, or some other Class D Felony, you may be eligible for the Court to enter judgment of conviction as a Class A misdemeanor. If you are charged with a Felony, it is important to seek immediate legal advice. Actions taken early in the case, including before Initial Hearing, can have an impact on obtaining a plea agreement to reduce your felony charge to a misdemeanor.

Misdemeanor treatment of a Class D felony can happen following a negotiated plea agreement or by the Court after a trial. In certain circumstances, the Court can reduce a prior Class D Felony conviction to a misdemeanor, after a timely-filed petition for misdemeanor treatment.
