Tippecanoe County has posted a revised bond schedule to address Indiana’s new felony sentences. If you are arrested, one of your highest priorities is to post bond and get out of jail. Effective on July 1, 2014, the bail schedule for all persons arrested without warrants for criminal offenses allegedly committed in Tippecanoe County will be as follows:

Misdemeanors           $250                            N/A
 
For Level 1, 2, 3, 4, and 5 felonies, a person must post both a cash and surety bond. Level 6 felony charges require only a cash bond. Cash bonds may be posted in the arrested person’s name only. At the end of a person’s case, cash bonds will be released to the defendant, less any court costs, restitution, or other fees ordered by the court.

Exceptions to Bond Schedule for Persons Living in Tippecanoe and Adjacent Counties

People who live in Tippecanoe, Benton, Carroll, Clinton, Fountain, Montgomery, Warren, or White County will not be subject to the bond schedule for charges of public intoxication, operating while intoxicated, minor consuming, possession of marijuana, or operating while suspended. In lieu of posting a bond, arrested persons will be held for a period of time based on the offense, breath test, or level of impairment and then released on their own recognizance.

If you are arrested and cannot afford to post bond, an attorney can file a petition to reduce the bail amount. Indiana law provides that bail may not be set higher than the amount reasonably required to assure your appearance in court or the safety of another person or the community. In seeking a bond reduction, the court will consider the length of time you have lived in the area, your employment status, and whether you have previously failed to appear for court appearances.
